2.1 The offers of the online shop on the Internet represent a non-binding invitation to the customer to order goods in the online shop.

2.2 By ordering the desired goods online, the customer makes a binding offer to conclude a purchase contract.

2.3 The online shop will confirm receipt of the order immediately. The order confirmation, as well as the receipt of a telephone order, does not constitute a legally binding acceptance on our part. Acceptance of the offer by us only occurs when we ship the goods to you. You will receive a written shipping confirmation via email.

2.4 The subject matter of the contract is the goods ordered by the customer. The description of the offer applies with regard to their quality.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, although this is not mandatory. You can download the withdrawal form.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts

for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer

6.1 All prices quoted are gross prices in euros, including statutory VAT at the current rate of 19%. The prices valid on the date of the order apply.

6.3 The delivered goods remain our property until full payment has been made. The customer must notify us immediately of any enforcement measures taken by third parties against the reserved goods and provide us with the documents necessary for intervention; this also applies to any other type of impairment. Irrespective of this, the customer must inform the third parties in advance of their existing rights to the goods.

If transport damage is discovered on the goods, we ask the recipient to immediately report the damage to the freight carrier (shipping service). Any other visible transport damage must be reported to us in writing within 3 days of receipt of the goods. Failure to do so will not affect your statutory rights. Otherwise, the statutory provisions apply.

We are not liable for defects resulting from improper handling, normal wear and tear, or external influences. Repairs to the goods carried out by the customer or by third parties without our written consent will void the warranty.

8.1 The online shop is liable in cases of intent or gross negligence in accordance with statutory provisions. Liability for guarantees is independent of fault. For slight negligence, the online shop is liable exclusively in accordance with the provisions of the Product Liability Act, for injury to life, body, or health, or for the breach of essential contractual obligations. However, the claim for damages for the slightly negligent breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless liability is assumed for injury to life, body, or health. The online shop is liable to the same extent for the negligence of vicarious agents and representatives.

8.2 The provisions of the preceding paragraph (8.1) extend to compensation for damages in addition to performance, compensation instead of performance and claims for compensation for wasted expenditure, regardless of the legal basis, including liability for defects, delay or impossibility.

Please note that the data required for business transactions will be processed and stored using a computer system. Personal data will, of course, be treated confidentially and used only for the purpose of processing your order.

If the contractual partner is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all claims arising from the contract shall be Augsburg. The right of Holzschnitzereien Landherr to sue the contractual partner at a general place of jurisdiction remains unaffected. Augsburg shall be the place of performance.

The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded; German law applies. By placing an order, you accept the online shop's General Terms and Conditions. Should any provision of these General Terms and Conditions be invalid for any reason, the validity of the remaining provisions shall remain unaffected.
